PRAYAGRAJ: Outgoing Chief Justice Pritinker Diwaker of the Allahabad high court caused a stir at his formal send-off late Tuesday by laying bare his hurt at the manner of his transfer from the Chhattisgarh HC in 2018 by the then Supreme Court collegium led by ex-CJI Dipak Mishra.He alleged that the move was “ill-intentioned and designed to harass me”, contrasting it with the current collegium’s recommendation to make him CJ of the Allahabad HC earlier this year.He thanked CJI D Y Chandrachud for “rectifying the injustice caused to me”, and his fellow judges and the bar for “turning this bane into a boon”.Terming his transfer to Allahabad five years ago "a sudden turn of events that descended upon me", Justice Diwaker left the gathering stunned with his remarks about retired CJI Mishra"…The then CJI showered on me some extra affection for reasons still not known to me, which entailed my transfer," he said, hours after presiding over his last court session.On Monday, an outgoing Calcutta HC judge compared the collegium's decision to shift "at one go" 24 judges with the transfer of 16 judges through an "executive decision" during the Emergency, saying it signalled the shift of power from the executive to the judiciary 48 years later.In Allahabad, Diwaker spoke of how he went about his task after his 2018 transfer.

Good work always leaves its footprint on the sands of time."Diwaker was made acting CJ on February 13 this year and appointed CJ on March 26.He said balancing a heavy workload was challenging, as was facing the brickbats.

"This court was subjected to criticism from various quarters in relation to its functioning, but I am of the firm belief that before reaching a particular conclusion, critics must see the shortcomings prevailing in the institution from inside."Diwaker said he never aspired to be a judge but became one due to destiny.

"I think when you love your profession, time seems to fly, carrying you swiftly towards success."Justice Manoj Kumar Gupta has been named the acting CJ of the Allahabad HC.
